PHI & HIPAA.

This policy is effective as of August 1 2025 .

At Elman Language Services, we are committed to protecting Protected Health Information (PHI) and complying with the Health Insurance Portability and Accountability Act (HIPAA). We take all potential violations seriously and have procedures in place to report, investigate, and resolve them.

1. What is a HIPAA Violation?

A HIPAA violation occurs when PHI is:

Shared without proper authorization.

Accessed or disclosed by an unauthorized person.

Transmitted through unsecured methods (such as personal email, text messages, or social media).

Left unprotected in paper or electronic form.

2. Reporting a Violation

Any interpreter, staff member, or client who suspects a HIPAA violation must report it immediately.

Reports may be made confidentially without fear of retaliation.

3. Investigation Process

All reported violations will be investigated promptly.

If a breach is confirmed, we will take immediate steps to mitigate the issue and prevent further disclosure.

Clients affected by a confirmed breach will be notified in accordance with HIPAA requirements.

4. Consequences of Violations

Interpreters or staff found responsible for a HIPAA violation may face disciplinary action, including termination of assignments.

Serious violations may also result in civil or criminal penalties under federal law.

5. Prevention Measures

All interpreters and staff receive HIPAA training and sign confidentiality agreements.

PHI is only accessed when necessary for interpretation/translation duties.

We regularly review our policies to ensure compliance with HIPAA standards.
